Custody Agreements 

It is usually in the best interest of the child to come to an agreement on a custody and visitation plan outside of court. When custody and visitation can be mutually agreed upon, the court usually approves the plan. If the parents fail to reach an agreement, the court will determine a plan. It considers a variety of factors including the ability of each parent to provide for the child, any evidence of abuse and if the child is of a certain age, his or her preferences.

Co-Parenting in Tennessee

In Tennessee, couples with children must go through a mandatory co-parenting education course if either party files for divorce. The court understands that mothers and fathers will parent differently from two different homes and that this can cause problems with the children. The class helps teach parents how to work together and be on the same page.

I will help you understand what to expect from the co-parenting classes and how to use them to promote the best interests of your children, while protecting your rights as a parent. I will also make certain that the provisions of the Parental Bill of Rights in the Tennessee divorce code are followed, so that your rights regarding phone calls, mail, notification and medical and school records are upheld. I will also make certain that any assets of the marriage are preserved if necessary to protect your children.

Modifications and Enforcement Actions

Often, once the divorce is final, the circumstances of one of the parents change dramatically, such that the agreed upon visitation schedule doesn't work anymore. One parent may need to move for work or health reasons which may have an impact on visitation or custody. In some situations, one parent may regularly violate the provisions of the divorce decree.

In such situations, I will work with you to find solutions that are in the best interests of your children, helping you file a motion for modification or enforcement, if necessary, or defending you in a modification or enforcement proceeding.
